Pfizer Inc. Wins Patent Protection for Viagra in Canadian Federal Court
Sept. 28 (Bloomberg) -- Pfizer Inc., the world's biggest drugmaker, won a Canadian court ruling that prevents Apotex Inc. from selling a generic version of the Viagra impotence medicine until a patent expires in 2014.
A Federal Court of Canada judge in Toronto ruled a generic drug proposed by closely held Apotex Inc. would infringe Pfizer's patent, New York-based Pfizer said today in a statement. Apotex will appeal, spokesman Elie Betito said in a telephone interview.
"We're definitely moving to the next level,'' he said. Taking the case to Canada's Federal Court of Appeal will be pursued in line with the company's goal of providing " affordable medication to patients,'' he said, adding that the appeal will probably take a year.
Today's ruling prevents Apotex, based in Weston, Ontario, from introducing a copy of Viagra for seven years. Pfizer is attempting to revive sales of Viagra, which have fallen 11 percent since 2003 to $1.7 billion a year, with a new advertising campaign.
Pfizer now competes in the market for treatments of erectile dysfunction with Eli Lilly & Co.'s Cialis and Bayer AG's Levitra.
A copy of the judgment wasn't immediately available on the court Web site.
Pfizer shares fell 32 cents to $24.43 in New York Stock Exchange composite trading. They have declined 5.7 percent this year.
